The ABC Board was created in 1944. There are three members of the Board: the Chairman, the Distilled Spirits Administrator and the Malt Beverage Administrator. The Kentucky Revised Statutes, chapters 241-244 and chapter 438 authorize the Board to regulate and oversee the alcoholic beverage industry.

Tobacco Hearings
Tobacco pre-hearing conference dates are held four times a year, on the third Tuesday of that month. If you have received a tobacco citation, you have two options:
- If you wish to plead guilty, you may pay your citation online or send your fine payment to the Frankfort office by mail before your pre-hearing conference date.

2. If you feel that you received the citation due to circumstances beyond your control, we encourage you to attend the pre-hearing conference. Tobacco pre-hearing conferences begin at 10 a.m. You will plead your case in front of the ABC Board. Failure to appear or pay your fine may result in your fine being doubled. You may also request a full board hearing at this conference.
The Office of Legal Services provides legal support and advice to the Department of Alcoholic Beverage Control. This division prosecutes licensees for alcohol violations and prosecutes individuals who sell tobacco in violation of Kentucky's teen tobacco laws. The legal staff also drafts regulations and legislation for the Department of Alcoholic Beverage Control in addition to providing legal information to licensees and the general public.
The Kentucky alcoholic beverage laws are found in Kentucky Revised Statutes Chapters 241 through 244 and administrative regulations are contained in 804 KAR, Chapters 1 through 13. The teen tobacco laws are contained in KRS 438.310 et seq.
