| 804 KAR 13 010E | This administrative regulation imposes penalties upon tobacco, nicotine, and vapor product retailers, wholesalers, and manufacturers who violate relevant statutory provisions or the department's administrative regulations related to tobacco, nicotine, or vapor products. After receiving public comments, the Department amended this emergency regulation in the following ways: amended Section 6(2) to clarify that ABC investigators may only seize contraband property, as defined by KRS 438.305(4), if found in inspections of TNVP licensed premises. And Section 6(3) was amended to clarify that contraband property and evidence used in an administrative proceeding regarding violations of KRS 438.305 to 438.350 would be destroyed only after the resolution of all appeals.
